Interview with attorney Andrzej Malicki – “Business Icons 2015”

Mr. Attorney, you founded the company in 1992, but you’ve previously worked in the profession.

Until 1983 I worked as an assistant at the University of Wrocław, where I taught law, population geography, demography and family law. At the beginning of 1980, I started to work as a lawyer. These were the times of lawyer teams. Interestingly, the Russians really wanted them to be state bar associations. But fortunately, there has always been an element of privacy in our profession. So there was an element of entrusting the case by the client.

Lawyers in the 1980s …

… they usually lived well. Some were very rich, but those who were moderately wealthy or with lower income lived on a good level. This also conditioned a certain level of ethics and a certain dignity of advocates. But also entrepreneurship – we have always lived on our own account. Well, the change in the system, the act on business, reminded the age-old question: who is an attorney – is he an entrepreneur or an attorney has a mission? It is definitely a profession of public trust according to art. 17 of the Constitution of the Republic of Poland. If the lawyer is to have a mission, it means that he has the right to act for free, that he has the right to act on official rates, whether he wants or does not want – he must. This is an element of missionaryity. But also at contractual rates, so that he can maintain the office so he can keep employees and himself.

In the end, you set up a company.

Now you can ask the question, why did I want the company? Four lawyers were sitting in the lawyer’s room in a small room. How could someone entrust delicate family matters, criminal, economic cases to lawyers, when the room was crowded and everyone heard everything? That’s why I really wanted to have my own room – to create decent conditions for the profession of public trust. In order for the client that he could sit down and know that no one eavesdrops on him. After all, the hallmark of the bar is mystery and intimacy. These are the characteristics of the profession.

Establishing a business was necessary for a better, more transparent profession.

Do you remember the first customer?

Perfectly. It was Maciej Kapelczak, the owner of Panda. Acquiring me through him was strange. At that time, I was active in the Sparta Wroclaw speedway club. As every sports club, no matter what, he did not have the money. I came to Mr. Kapelczak to ask for financial support. It was before the denomination. We needed two million zlotys to go to Krosno. Panda was a chain of stores with alcohol, kiosks, and bread sales. It all gave big money. At the meeting, the owner of “Panda” said “There is 10 million under this chair to take it” I took this money. In about 10 days Maciej Kapelczak called the club and asked: “Did Mr. Malicki pay something to the club”? She replied: “There are 10 million paid seven days ago.” Kapelczak demanded that I appear before him. I went and heard: “Because you have been honest and everyone is robbing me, you will be my advocate and adviser.”

My other great client was “Pafawag”. From 1994 to the present, the Malicki and Partners attorneys’ company has been providing legal services to a greater or lesser extent. Management boards change, names change, owners change, and my office is still there.

Did you want to deal with politics, like your former partner, Robert Rossa?

No … On the other hand, it happened that I was very close to politics. I helped just attorney Henryk Rossa in the election campaign. I am, for years, a speaker on Sparta Wroclaw speedway matches. I announce the race via microphone and give their cast. At the beginning of the 90s I asked the fans: “Do you believe me?” They answered loudly: “Yes.” I believe Henryk Rossa so you shall also trust him. ” At that time, there was no pre-election silence and he won the Senate election with 1500 votes.

Please describe the court case that you have remembered the most.

It’s so … My client was accused of driving a polish transport car “Żuk”- hit the passer-by and caused his death. The judge, who was judged seriously and judged most cases of road accidents in Wrocław, asked the accused at the very beginning of the trial whether he had a driving license. He said he has. And the judge said that he will not have it anymore. You can not anticipate the verdict, it practically should turn off the judge, because he revealed the position in the case. However, as a young lawyer, I preferred not to upset the court. My client did not plead guilty. He explained that he did not cause death, explained that the deceased was lying on the roadway, he did not see him, he did not have a reflective vest and therefore he rode over him … An expert was appointed, who said: “I do not rule out multiple rides by other vehicles”. Of course, every ride on corpses is inelegant and is an offense. But it has become obsolete. An acquittal was issued, it was my success.

I remember in one of the cases on which the film was made, which I co-authored with Wiesław Saniewski – “Immensity of Justice”, where the prosecutor demanded a penalty of 15 years imprisonment in the circumstances of the victim’s pregnancy, strangling, sinking, beating against the perpetrator of the accused director. … I was sitting next to this prosecutor. I said – I do not understand. If there are any doubts, ask the prosecutor for an acquittal. But if there is no doubt, then lifesentence should be demanded.

Your hobby?

Sailing. I am a sailing instructor and a yacht helmsman. I am also a licensed announcer of speedway competitions. A man says that I perform masses at the stadium. But he always liked the mass, I believe that most fans also.

I am also a lecturer. I teach sports law at the University of Lower Silesia and medical law at the Faculty of Law, Administration and Economics at the University of Wrocław as part of a postgraduate study. I conduct classes with advocate trainees. I try to publish a lot, I am a member of the Supreme Bar Council, I retain activity in the local bar association. I performed all the functions from a board member through a 12-year training manager, Vice-Dean and dean. I expanded the headquarters of our bar making it modern.

BUSINESS ICONS 2015

Business icons is another social program of the Wrocław Chamber of Commerce. Its aim is to honour entrepreneurs who have already made their first steps in business during the period of economic transformation and are still active in this area of ​​their lives. Honoring people who have developed their businesses have survived the clash with the open, free market of Europe and the capital of Western corporations. Thanks to their work, the companies that run have become widely known and appreciated.

There were 246 applications to the plebiscite, of which several dozen entrepreneurs were selected. The criteria for selecting nominees for the title were:

  1. A minimum of 20 years of documented economic activity in the private sector.
  2. Relative to the industry revenues throughout the entire period of activity.
  3. Position of the industry / sector leader on the local market.
  4. No criminal record for intentional crimes.
  5. High employment relative to the industry.
  6. Regulated legal and property situation of the enterprise.
  7. Lack of public and legal arrears.
  8. Social activity.

dr Anna Malicka – Ochtera

We are pleased to announce that on 28 September 2015, Adv. Anna Malicka – Ochtera received a PhD in legal sciences based on the work “Limits of the defender’s actions in the criminal trial”. The promoter of the work was prof. dr hab. Jerzy Skorupka, and reviewers of prof. dr hab. Jacek Giezek and prof. dr hab. Paweł Wiliński. On the basis of the Resolution of the Faculty Council, the dissertation was awarded and submitted to the “State and Law” competition for the best doctoral dissertation.

Devil’s advocate? He will defend Kajetan P. accused of brutal murder.

They call him the star of the Warsaw Bar and lawyer who does not refuse to accept matters that are considered hopeless or controversial. However, the one he takes care of now may bring him not only greater fame, but also it can bring many problems. Tadeusz Wolfowicz will most probably defend Kajetan P., whose crime has shaken Poland. The public has already passed the verdict, and the capital attorney will have a hard nut to crack. He already has to face a wave of criticism. How can you defend such a degenerate? – some people ask.

Wolfowicz – an advocate of difficult cases.

“I know that such a profession, but what must be conscientious to consciously help murderers?”, “I am ashamed Mr. attorney – to defend such a degenerate for money, it is unbelivable, how will you Mister live with it?”, ” How low can you fall to defend a degenerated murderer? “Did this lawyer think for a moment about the parents and relatives of this girl?” – this is just a small sample of how ordinary people reacted to the news that Kajetan P. already found defender. In fact, his family found him, who a few days ago, without waiting for the development of events, decided in advance to ensure that the man had a worthy representative in court.

It was Tadeusz Wolfowicz, a lawyer in Warsaw, who is known for not refusing help in difficult cases, as well as for the fact that he can draw his clients out of a lot of problems. Mr Wolfowicz has so far specialized in matters related to traffic accidents. With publicity and media noise Wolfowicz meets not for the first time. The Warsaw lawyer has several high-profile processes that have excited the whole of Poland.

One of them was the case of Otylia Jędrzejczak, a titled swimmer who in 2005 caused a tragic accident in which her brother, 19-year-old Szymon, died. Jędrzejczak was finally sentenced to 9 months of restriction of liberty and a ban on driving a car for a year. This sentence, as commented on by law experts, was exceptionally gentle. Merits for such a low penalty were attributed to a valued advocate from Warsaw.

Another issue that in the past aroused many emotions, and in which Wolfowicz was involved, was the loud trial of Nicholas P. This Warsaw road pirate in 2006 drove the car at a speed of about 100km / h into a group of several people standing at one of Warsaw stops. As a result of this tragic accident, 5 people died. Public opinion and the victims’ families did not leave a dry thread on Nicholas, calling him “a murderer” and demanding the highest possible punishment.

The prosecutor’s office accused him of deliberately causing a disaster in land traffic with a fatal outcome, for which he could face up to 12 years in prison. Wolfowicz said then that “it might seem that it is a punishment too gentle for the murderer, but Nicholas P. is not a murderer, the proposed punishment can not be a form of retaliation.” This statement well reflects the attorney’s approach to his clients and matters on which he protects. Professionalism, cool and rational calculation, far from the emotional tone of outside observers.

Currently, Wolfowicz will probably have a lot on his mind. If he really will be the protector of Kajetan P., hailed as “Hannibal of Zoliborz”, and everything points to that, he will have to run another loud case in parallel. It’s about Dariusz K., a celebrity and former partner of Edyta Górniak, who in 2014 killed a 63-year-old woman on a pedestrian crossing, most likely after taking cocaine. Dariusz K., has two defenders: mentioned Wolfowicz and attorney Marcin Kondracki. Kondracki admits that he is uncomfortable speaking about cooperation with Wolfowicz, but adds that he evaluates his work very highly. – He is uncompromising and professional – he tells us.

Lawyer’s profession

However, the case of the bestial murder in Warsaw’s Żoliborz may be even more difficult for a valued attorney than all the aforementioned judicial battles. This cruel crime electrified whole Poland, and the Poles are closely monitoring every new information about the recently caught in Malta librarian-degenerate.

And there is nothing to hide, many people will certainly find it difficult to maintain a neutral stance also towards the defender of Kajetan P. There is already a big rumour that being an advocate is unthinkable. The legal environment, however, looks at this issue differently.

“There are some questions about why Mr. Wolfowicz will be the defender of Kajetan P. The answer is simple. Because he does his profession. Please remember that we are not judges in the case. We are the judges of the case process. In the sense that we do not defend man, we only defend the rules. There is no doubt that it was a savage murder, but in the face of the law everyone has the right to defend without exception. ”

Malicki adds that on the occasion of extremely cruel crimes, defenders of perpetrators get backfire for what their client has committed. – But it results from the ignorance of the law and from the fact that we do not understand what the lawyer’s function is. The demand for a high penalty is understandable, but, I will emphasize it once again, everyone has the right to defend. Mr. Kajetan too – says the lawyer.

A similar opinion is Edyta Tawrel, who was the defender of Beata Z., a child murderer from Hipolitowo. As she admits, people often misunderstand the profession of a lawyer and evaluate their actions in a negative way. – Everyone deserves to be defended and our legal system guarantees it.

“Do lawyers have moral dilemmas, resistance to accept such cases? If you do this job and treat it as a kind of mission, I really do not know what would have happened to refuse to defend someone. I can not imagine a situation in which I refuse to help anyone in the form of professional defense. Ordinary people look at such matters from a completely different perspective. An attorney can not afford it, we operate on a completely different area. This is our profession. And that part of the society may not like it, it’s obvious. This kind of criticism is part of our profession. “

Conference “The burden of proof and obligation to prove in a criminal trial”

On 11 April 2016, at the Faculty of Law, Administration and Economics of the University of Wrocław, as part of Program IV of the Wrocław Carnoprocessary Seminary, a conference was held on the subject of “The burden of proof and the obligation to prove in a criminal trial.”

National Congress of the Advocates, November 25-27, 2016.

Attorney Andrzej Malicki at the last National Congress of the Bar, held on November 25-27, 2016, in Cracow, was re-elected to the Supreme Bar Council and appointed by the Presidium of the Supreme Bar Council to the position of Vice-President of the Ethics Committee of the Supreme Bar Council.

Attorney Andrzej Malicki conducts training classes with trainee advocates of the Chamber of Advocates in Wałbrzych. He also gives lectures under the title “Law and sport” at the University of Lower Silesia in Wrocław, “Legal responsibility of doctors and the settlement of medical disputes” at the Postgraduate Studies in Medical Law and Bioethics at the University of Wrocław. He runs Classes as part of professional training for lawyers in the Bar Association in Warsaw. He cooperates with the Lower Silesian Chamber of Medicine in Wroclaw, conducts training classes for doctors and is a member of the Provincial Commission for the adjudication of medical events in Wroclaw.

The final of the National Oratory Competition

The final of the Stanisława Mikke’s National Oratory Contest for Trainee advocates took place on February 18 this year. in Cracow. One of the members of jury was adv. Andrzej Malicki.

The competition was attended by 12 applicants, winners of environmental eliminations, who presented speeches in the role of procedural representatives in civil proceedings or as a defense attorney or proxy of an auxiliary prosecutor in a criminal trial.

After hearing the speeches of all contestants, the jury evaluated them, taking into account the correctness of the legal issues, style and language of the speech, its form, phonetic correctness, construction of the speech, as well as the presentation of the facts and general impression.

The first place was taken by apl. advocate. Angelika Jędryka-Pihut from the Bydgoszcz Chamber, the second place was for advocate Dagmara Jagodzińska from the Bielsko-Biała Chamber, third place received advocate Julia Szkudlarek from the Łódź Chamber.

The jury awarded the trainee advocates: Agata Kleczkowska from the chamber in Toruń, Jacek Tomasz Golan from the chamber in Warsaw and Maria Skotnicka from the Krakow chamber. Additionally, apl. advocate. Agata Kleczkowska received a special award for “a unique speech” from Mrs. Bożena Mikke, wife of the patron of the Oratory Competition, late advocate Stanisława Mikke.

Not only the winners of the competition received diplomas, but also other participants. Andrzej Malicki and Przemysław Branny shared the remarks about the applicants’ speeches with the laureates and the gathered audience.

The competition was conducted by a jury composed of: chairman adv. Andrzej Zwara, director of OBA, adv. Paweł Gieras, dean of the ORA in Cracow, adv. Elżbieta Nowak, chairwoman of the training commission for NRA trainee advocate, adv. Justyna Mazur, dean of the ORA in Bydgoszcz, adv. Bartosz Tiutiunik, adv. Andrzej Malicki, delegate of ORA and Przemysław Branny, actor of the Cracow Bagatela Theater.

Patients’ rights – without anesthesia

On 27 May this year, at the Old Stock Exchange Building at Plac Solny 16 in Wrocław, the conference was organized with the participation of the Chairman of the Human Rights Commission at NRA Adv. Justyna Metelska and the Chairwoman of the Women’s Team at NRA Adv. Katarzyna Gajowniczek – Pruszyńska titled “Rights of patients – without anesthesia”.
